Akhil Sheth’s practice focuses on high-stakes business disputes. For over a decade, Akhil has litigated complex commercial and intellectual property cases at several multinational law firms. He has helped clients across a broad range of industries in pre-litigation and litigation matters and trials. In one trial, Akhil successfully represented a leading multinational telecommunications company in a four-week federal bench trial where his client was found not to have breached its FRAND licensing obligations. Akhil has also disposed of cases at an early stage through his superb motion practice.
Akhil previously served as a federal law clerk at the U.S. Court of Appeals for the Ninth Circuit and the U.S. District Court for the Central District of California. During his federal judicial clerkships, Akhil wrote orders, published opinions, and bench memoranda covering a wide array of matters, including private litigation, federal agency matters, and federal criminal matters.
Outside his practice, Akhil is heavily involved in his community, particularly on issues relating to access to justice and diversity in the legal profession. He also regularly writes about antitrust, business litigation, and legal writing developments.
American Bar Foundation Fellow
Represented a leading multinational telecommunications company in a four-week federal bench trial to determine fair, reasonable, and non-discriminatory (FRAND) licensing terms for the company’s portfolio of standard-essential mobile-telecommunications patents. Helped win a verdict determining that the company did not breach its FRAND licensing obligations.
Defended a major port and its chief executive in a federal antitrust lawsuit filed by a developer following failed negotiations to develop port property. Helped obtain pre-discovery dismissal of the antitrust claims against both the port and port executive.
Represented a state contractor in a federal dispute with a state agency over payment delays and interpretation of payment terms. Obtained preliminary injunctive relief requiring the state agency to come up to date on payments and helped the contractor resolve the matter favorably before dispositive motion practice.
Defended a major university in a state court lawsuit alleging that the university improperly allowed unauthorized access to the opposing party’s proprietary research. Helped the university resolve the matter favorably before trial.
Represented a bank in a federal dispute with a financial technology company over the creation of an automated online loan application processing platform. Helped the bank resolve the matter favorably before dispositive motion practice.
Defended a Chinese company and its U.S. subsidiary in a whistleblower/wrongful termination lawsuit filed by a former executive in state court. Helped secure dismissal of the parent company on appeal. During a three-week state jury trial, helped get the opposing party’s expert testimony excluded and secured a jury verdict that found in part that the opposing party had breached his fiduciary duty to his employer.
Defended a Big Three auto manufacturer in follow-on federal litigation filed by a plaintiff seeking a new, friendlier forum. Helped the client resolve the matter favorably after successfully moving to transfer the matter back to the original forum.
Defended a national economy lodging company in numerous federal disputes alleging that the company facilitated human trafficking at its motels. Among other things, helped successfully defeat multiple efforts by plaintiffs’ counsel to consolidate nationwide cases into a multidistrict litigation.
Represented one of the nation’s largest health insurers in two federal class actions alleging breach of fiduciary duty under ERISA. Helped successfully defeat the plaintiffs’ nine-figure disgorgement claims at summary judgment. Following a three-week bench trial, helped win reversal on appeal of the trial judge’s order awarding injunctive relief to the class.
Represented a regional health plan in binding arbitration filed by a health care provider asserting contract-related claims. Helped settle the matter following a two-week arbitration hearing.
Represented a multinational oil company in a federal product liability case alleging oxygenate contamination of groundwater. Helped the client resolve the matter favorably following the first week of a scheduled ten-week jury trial.
