Kevin M. Yopp is a trial lawyer with more than 20 years of experience representing clients in complex commercial and high-stakes tort disputes. His clients have ranged from individual entrepreneurs, executives, and start-up companies to publicly-traded corporations and high-net-worth individuals.
Kevin is known for his strategic judgment, persuasive motion practice, and effective courtroom advocacy in sophisticated, high-stakes matters. He represents both plaintiffs and defendants and brings a deep personal commitment to each case. That combination of skill and commitment has consistently produced exceptional results at every stage of litigation, from early case assessment and settlement discussions through trial.
Before law school, Kevin served in the United States Army as an M1A1 Abrams tank driver. He served in the First Armored Division (“Old Ironsides”), Second Infantry Division (“Indianhead”), and 11th Armored Cavalry Regiment (“Blackhorse”). While with the First Armored Division, his platoon earned a rare perfect score in tank platoon gunnery (Table XII).
Lead trial counsel for entrepreneurs in disputes over asset purchases. Obtained a $14.6 million jury verdict from a unanimous federal jury, who, after a two-week trial, needed less than two hours to deliberate before finding for Kevin’s client.
Trial counsel for a Major League Baseball organization in a three-month wrongful death jury trial seeking over $1 billion in damages, brought by the family of a player who died of a drug overdose.
Lead counsel for plaintiff in action against an Am Law 200 law firm and two of its partners for conversion (civil theft) of funds. Obtained a confidential, seven-figure settlement.
Trial counsel for an industry-leading global customer experience management company in a four-week jury trial against a global technology company involving fraud and contract claims totaling hundreds of millions of dollars.
Lead counsel for plaintiff in actions in Los Angeles and the Delaware Court of Chancery opposing a freeze-out merger. Obtained an extremely favorable settlement for Kevin’s client (the company co-founder) of nearly 100x the offered merger consideration.
Lead counsel for a real estate developer defending against multiple causes of action. Successfully had all claims dismissed on demurrer except for a single negligence claim. Then, obtained a walk-away settlement after taking one deposition.
Lead counsel in federal court litigation involving a media company in the Southern District of New York. Moved to transfer venue from New York to Los Angeles, which the court granted, effectively ending the case.
Defended an insurance broker in multiple state and federal cases involving claims ranging from discrimination to fraud. Obtained dismissal of all actions, including obtaining terminating sanctions to dispose of the final case, sanctions against opposing counsel personally, and attorneys’ fees.
Lead counsel in state and federal litigation involving multimillion-dollar commercial real estate transactions, including disputes over deposits after failed deals.
Lead counsel in arbitration involving claims against the client by a former executive. Negotiated an extremely favorable settlement that was a fraction of estimated defense costs.
Represented a large, publicly-traded defense contractor in an appeal from an adverse fraud and breach-of-contract judgment, including multimillion-dollar punitive damages, after substitution for prior trial counsel. Obtained a favorable settlement of the matter.
Represented property owners in cases against local governments, including a federal constitutional challenge to the City of Carson’s rent control law. (Also represented property owners in view disputes, noise complaints, and residential real estate litigation.)
Counseled a consumer electronics company in matters concerning the enforcement of Chinese arbitration awards arising from the purchase of its product from a Chinese state-owned company. Successfully obtained a writ of supersedeas from the California Court of Appeal to stay threatened auction of client’s property.
Defended an industry-leading pharmaceutical company in nationwide multidistrict litigation arising from claims involving a withdrawn prescription drug, including personal injury and class action cases.
Represented a high school basketball player pro bono in CIF athletic eligibility hearings.
